Location Rental For Photoshoot

1. This agreement grants limited access to the gardens of Moss Mountain Farm, including the following: The Terrace Garden, The Wisteria Garden, The East Garden, The Hidden Rose Garden, Daffodil Hill, and the Vegetable Garden (some areas may not be available on each date due to seasonal or climatic conditions). The client explicitly understands that all other areas are not accessible, including Poultryville, and the Main House and dependencies.  Client and photographer agree to contain their movements and photography to these areas and will park in the designated parking area. The farm agrees to allow temporary parking access for equipment drop-off for the client and photographer’s convenience. We will provide a climate-controlled changing area for photography equipment and bathroom access.
2. The use of Moss Mountain Farm is only for agreed-upon photoshoot booked. Moss Mountain Farm reserves the right to disallow the public distribution of any material identified as the farm that is deemed objectionable. No boudoir photography nor nudity is permitted.  
3. Client and photographer agree to provide digital, publishable-quality files to Moss Mountain Farm, rights-free, for usage in the farm’s and its associates’ media and publications within a 2-month period of delivery to the client. Please email images to gardenhome@pallensmith.com
4. The photoshoot shall be limited to up to four individuals including the client(s), photographer, and up to 2 assistants or family members.  The session is not intended as a tour of the property, “private touring” (aside from shoot scouting) is disallowed. 
5. Moss Mountain Farm is a non-smoking property with sensitive environmental, animal, and plant installations.  
6. Any damages incurred due to negligence of the client or client’s photographer will be charged directly back to the client within 14 business days. 

Payment and agreeing to the terms and conditions when booking serves as acceptance of these terms and secures the photoshoot.
